Specific Cautions

HVCC mandates the use of a third party representative who manages all appraiser related information, and is not paid out of the commissions of closed loans. However, the moment an AMC needs to discuss the valuation or methods of a particular appraisal assignment, the AMC and Lender ventures dangerously close to violating the intent and requirements of the HVCC.

A lender CANNOT use any appraisal reports obtained by or through an Appraisal Management Company (AMC) that is owned by the lender or an affiliate of the lender unless the ownership interest is less than 20%, the lender has no involvement in the day-to-day business operations of the AMC, the AMC is operated independently and the lender plays no part in the selection of the appraisers.

NOTE - Since many of the AMC's are owned, in whole or part by major lending institutions we expect to see a mass migration and divestiture of such holdings by lending institutions in the near future.
